ANSWER: Yes the ADA has impact for electric vehicle charging stations. Section 201.1 of the ADA Standards requires all areas of newly designed and newly constructed buildings and facilities to comply with the Standards. Section 205.1 requires operable parts to comply with the Standards. Therefore, even though there is not a specific requirement in the ADA Standards for electric vehicle charging stations they would fall under these provisions. Furthermore, 42 U.S. Code § 12182(a) states that no individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations. If an electric vehicle charging station is provided to the general public in a non-accessible manner (i.e. not in compliance with the Standards) it would be discrimination and therefore in violation of the ADA.
